Re: Quebec Supreme Court Reference
You should not wait until Jean Chretien's stacked supreme court reaches the inevitable verdict that makes succession virtually impossible for Quebec and any other province desiring autonomy. I suggest that you could establish by provincial law the "Quebec Supreme Court of Constitutional Affairs" and submit the question to it; "Is Quebec entitle to succession by its own referendum?"
For once, the court could be elected from a series of learned experts in Constitutional Law by the citizens of Quebec. This would be more credible than a court of Judges picked hand-picked by the Prime Minister and special interests that can never reflect the spirit of the people of Quebec.
The Quebec Supreme "Constitutional Court" could decide Quebec is an oppressed nation entitled to unilateral succession. If the Supreme Court of Canada requires some other provinces permission to secede, then Quebec is oppressed and can do so unilaterally.
The Supreme Court of Canada has recognized native rights to self government. To deny Quebec the same right even after referendum would be unequal treatment contrary to section 15 of the Charter of Rights.
